Terms and Conditions - Spelling Bee Amazing

By downloading, installing, or using the "Spelling Bee Amazing" application ("the App") provided by flee flame, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

1. Educational Purpose

Spelling Bee Amazing is an educational tool designed to help users practice and improve their spelling skills. The App is intended for personal, educational, and non-commercial use only.

2. License Grant

Subject to your compliance with these Terms, flee flame grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, educational purposes
• Practice spelling using the provided word lists and features

3. Subscriptions

Spelling Bee Amazing offers both free and optional premium subscription tiers. Feature availability may vary between tiers and may change over time.

Pricing and Billing

• Price: As displayed in the Apple App Store or Google Play Store at the time of purchase
• Payment: Charged to your Apple App Store or Google Play Store account at confirmation of purchase
• Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period

Managing Subscriptions

You can manage and cancel your subscription at any time through:

• iOS: Settings → [Your Name] → Subscriptions
• Android: Google Play Store → Menu → Subscriptions

No Refunds: Payments are non-refundable except where required by law. No refunds will be provided for any unused portion of a subscription period.

Free Trials

If we offer a free trial period, you will be charged the subscription price at the end of the trial period unless you cancel before the trial ends. Once charged, no refunds will be provided for the unused trial period.

Subscription Changes

flee flame reserves the right to modify subscription pricing, features, or terms with advance notice. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. You may cancel before renewal if you do not accept the new pricing.

4. Restrictions

You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Copy, modify, distribute, sell, or lease any part of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any commercial purpose without written permission
• Extract or redistribute word lists for commercial purposes
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App or its systems
• Share premium subscription access with others or attempt to circumvent payment requirements

5. Word Lists and Content

The App includes curated word lists for spelling practice at various difficulty levels. These lists are provided for educational purposes only.

Important: Official competition word lists (such as Words of the Champions by Scripps National Spelling Bee) are copyrighted materials owned by their respective organizations. The App does not include these proprietary lists. Users may import their own word lists through the Custom Lists feature for personal practice.

All word definitions, language origins, and related educational content are provided for informational purposes and are derived from publicly available sources or generated for educational use.

6. No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. flee flame makes no warranties, express or implied, including but not limited to:

• Fitness for a particular purpose
• Accuracy of pronunciation, definitions, or spelling information
• Uninterrupted or error-free operation
• Success in spelling competitions or academic performance
• Continued availability of premium features

While we strive for accuracy, spelling, pronunciation, and educational content may contain errors. The App is a supplementary learning tool and should not be the sole resource for competition preparation or academic study.

7. Limitation of Liability

To the maximum extent permitted by law, flee flame and its developers shall not be liable for any:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, or profits
• Damages resulting from use or inability to use the App
• Damages from errors or inaccuracies in spelling, pronunciation, or definitions
• Competition performance or academic outcomes
• Payment processing issues with Apple App Store or Google Play Store
• Interruption or termination of premium features

Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.

8. Third-Party Services

The App uses the following third-party services:

• RevenueCat: For subscription management and premium access verification. Your use of RevenueCat services is subject to their Terms of Service.
• Apple App Store / Google Play Store: For payment processing and subscription management. All purchases are subject to the applicable store's terms and conditions.
• Text-to-Speech (TTS): Device-provided services for word pronunciation. The quality and accuracy of pronunciation depend on your device's capabilities and installed voices.

flee flame is not responsible for the quality, accuracy, or availability of third-party services.

9. User-Generated Content

If you import custom word lists, you are responsible for ensuring you have the right to use such content and that it does not infringe on any third-party rights. You retain all rights to your imported content.

10. Age Requirements

The App is designed for users of all ages. Children under 13 should use the App with parental guidance and supervision. Parents and guardians are responsible for monitoring their children's use of the App and purchases made through the App.

11. Competition Disclaimer

The App is NOT affiliated with, endorsed by, or sponsored by:

• Scripps National Spelling Bee
• Any official spelling bee organization
• Educational testing services or school districts

"Spelling Bee" is a general term referring to spelling competitions. Using this App does not guarantee success in any competition. Official competition preparation should include official materials and resources provided by competition organizers.

12. Updates and Modifications

flee flame reserves the right to:

• Modify, update, or discontinue the App or any features at any time
• Change word lists, difficulty levels, or game mechanics
• Add or remove features in future updates

Updates may be required to continue using the App. Continued use after updates constitutes acceptance of any changes.

13. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we handle data.

14. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use of the App and delete it from your devices. Active subscriptions will continue until the end of the current billing period unless cancelled separately through the App Store or Google Play Store.

15. Intellectual Property

The App, including its design, graphics, user interface, code, and content (excluding user-imported content), is owned by flee flame and is protected by copyright, trademark, and other intellectual property laws.

"Spelling Bee Amazing" and the bee logo are trademarks of flee flame.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which flee flame operates, without regard to its conflict of law provisions.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting with an updated "Effective Date." Your continued use of the App after changes constitutes acceptance of the modified Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
